The Court completes the reasoning of the judges of the Supreme Court in the Judgment n. 4184/2012: as you recall, the Supreme Court had already said that marriage contract abroad for two people is valid and exists but, in the absence of action by the Italian legislature, would not produce effects in our system.
The Judges of Grosseto add, however, that not transcribe marriages between persons of the same sex would result in non-recognition of a status validly acquired abroad and that the individual has the right to have recognized this status, although this right may no arise that complex of rights and duties which form the marriage relationship.
Thus, although in Italy is not recognized the validity of the marriage between persons of the same sex, is a right of individuals to be able to give advertising in our legal status of spouses validly acquired abroad.

IL TRIBUNALE DI GROSSETO DICE SI ALLA TRASCRIZIONE DEL MATRIMONIO CELEBRATO ALL’ESTERO DA PERSONE DELLO STESSO SESSO

Il Tribunale di Grosseto conferma la propria decisione di ritenere pienamente legittima la trascrizione del matrimonio celebrato all’estero da persone omosessuali.
La Corte di Appello di Firenze aveva annullato per questioni di procedura la precedente decisione dello stesso Tribunale che ammetteva la trascrizione ed il Tribunale, chiamato a pronunciarsi nuovamente, ha ritenuto di non mutare indirizzo rispetto alla propria pronuncia di quasi un anno prima.
I giudici ampliano notevolmente gli argomenti posti a sostegno della trascrivibilità del matrimonio e riconoscono che non esiste nel nostro ordinamento interno alcuna norma che impedisca a persone dello stesso sesso di unirsi in matrimonio.
Neppure l’art. 29 della Costituzione che fa riferimento alla società naturale fondata sul matrimonio può essere interpretato a favore della famiglia tradizionale formata da uomo e donna poiché, per i giudici grossetani, anche l’unione omosessuale deve essere intesa come “formazione sociale spontanea” e dunque si presenta con caratteristiche altrettanto naturali quanto l’unione fra un uomo e una donna.
I Giudici poi si intrattengono a lungo sull’efficacia delle norme di diritto internazionale ed affermano che quel complesso di principi che costituisce l’ordine pubblico internazionale consente di considerare legittimo il matrimonio fra persone dello stesso sesso.
Il Tribunale porta a compimento il ragionamento dei giudici della Corte di Cassazione nella Sentenza n. 4184/2012: come si ricorderà la Cassazione aveva già detto che il matrimonio contratto all’estero da due persone è valido ed esistente ma, in mancanza di un intervento del legislatore italiano, non produrrebbe effetti nel nostro ordinamento.
I Giudici di Grosseto aggiungono però che non trascrivere i matrimoni fra persone dello stesso sesso si tradurrebbe nel mancato riconoscimento di uno status acquisito validamente all’estero e che l’individuo ha il diritto di veder riconosciuto questo status, anche se da questo diritto non possa sorgere quel complesso di diritti e doveri che costituiscono il rapporto matrimoniale.
Dunque, anche se in Italia non è riconosciuta la validità del matrimonio fra persone dello stesso sesso, costituisce un diritto degli individui quello di poter dare pubblicità nel nostro ordinamento allo stato di coniugi acquisito validamente all’estero.
